1. Acceptance
By creating a Windfall account or using getwindfall.io ("the Service") you agree to these Terms. If you do not agree, do not use the Service.
2. What Windfall does
Windfall is a software tool that matches your business or nonprofit with U.S. federal, state, and private grant programs, and helps you organize applications. Windfall is not a grant writer, a lawyer, or a financial advisor, and does not guarantee that you will be awarded any grant.
3. Your account
You are responsible for keeping your login credentials secure and for everything that happens under your account. Provide accurate business information — the quality of your matches depends on it. One person, one account. Do not share your account with third parties.
4. Subscriptions and billing
- Paid plans (SMB $49/mo, Nonprofit $199/mo, AI Writing $299/mo) renew monthly until canceled.
- You can cancel at any time from Settings → Billing. Cancellation stops the next renewal; the current period is not prorated.
- Payments are processed by Stripe. Windfall does not store your card details.
- Refunds are handled per our Refund Policy.
5. AI Writing plan
The AI Writing plan uses Anthropic Claude to generate draft grant narratives from your business profile and the grant's stated criteria. Drafts are limited to 10 per day per user to protect our API costs. Drafts are starting points: you are responsible for reviewing every draft for accuracy, factual claims, and compliance with the grantor's rules before submission.
6. Acceptable use
You agree not to:
- submit false or misleading information to grantors using Windfall,
- scrape or resell Windfall's grant data,
- attempt to bypass paywalls, rate limits, or authentication,
- use Windfall for anything illegal or that violates a grantor's terms.
7. Third-party grants
Grant data comes from public sources including Grants.gov and SAM.gov. Windfall does not warrant that this data is complete, current, or accurate. Always verify eligibility and deadlines with the grantor before applying. Windfall is not a party to any application you submit and cannot influence outcomes.
8. Intellectual property
We retain all rights to the Windfall service, brand, and matching algorithms. You retain all rights to your business data, draft narratives, and application content. By using the AI Writing feature you grant Windfall a limited right to process your inputs through the Claude API for the sole purpose of returning your draft.
9. Termination
We may suspend or terminate accounts that violate these Terms, at our discretion. You may delete your account at any time by emailing support@getwindfall.io. On deletion we remove your profile and match history within 30 days; anonymized aggregate analytics may be retained.
10. Disclaimers
The Service is provided "as is". To the fullest extent permitted by law, Windfall disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Windfall's total aggregate liability for any claim shall not exceed the fees you paid to Windfall in the 12 months preceding the claim.
11. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of laws principles. Disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
12. Changes
We may update these Terms. Material changes will be announced by email at least 15 days before taking effect. Continued use of Windfall after that date constitutes acceptance.
